The provisions contained in these general conditions apply to and govern the contract entered into in person or through this website www.embodylisboa.com (the “Website”) between Routinealangement Lda., a limited liability company, registered under the unique registration and identification number tax 517557398, with registered office at Rua Ferreira Lapa, nº 26A, R/C 31, 1150-158 Lisboa (Freguesia de Arroios) (“Embody Wellness”) and the client (“Client”), identified on the receipt of contractual adherence, regarding access and use by the Client of the physical facilities of the space located at Rua Ferreira Lapa, nº 26A, R/C 31 (“Space”), as well as the equipment and services provided by Embody Wellness in relation to to the physical and sporting activities (“Contract”).
The Website is owned and operated by Embody Wellness. These terms and conditions include the general conditions of use of this Website and of the Contract relating to the services provided by Embody Wellness on the Website and in the Space. The Client must carefully read these general conditions and declare agreement with these terms and conditions.
1. OBJECT OF THE CONTRACT The purpose of the Contract is (i) the access to the Embody Wellness Space by the Client, as well as (ii) the use by the Client of the Space’s facilities, equipment and services provided by Embody Wellness for the practice of physical and sporting activities.
2. CONCLUSION OF THE CONTRACT 2.1. The Contract will be considered entered into between Embody Wellness and the Client at the moment that the purchase order for the training Packages, submitted electronically by the Client through this Website or in person at the Space, is effectively accepted by Embody Wellness. 2.1.1. Acceptance is considered to have taken place on the date that Embody Wellness sends proof of acceptance to the Client, electronically via the Website, by email or by physical document delivered in person at the Space. 2.1.2. If, for any reason, Embody Wellness refuses the purchase order submitted by the Client, the contract will not be considered validly concluded and the amounts paid by the Client at the time of the purchase order will be refunded within 5 days, no indemnification being owed by Embody Wellness to the Client.


3. ACTIVITIES PROVIDED BY EMBODY WELLNESS 3.1. The physical activities provided by Embody Wellness in the Space include (jointly the “Activities”): Use of the open space of the Space, including available materials and equipment, by the Client (“Open Gym”);Personal training session with a Personal trainer allocated by Embody Wellness (“PT Session”); andGroup classes provided for a group of Clients led by an instructor allocated by Embody Wellness (“Classes”).
3.2. The Client’s participation in physical Activities promoted by Embody Wellness is always subject to the availability of slots for scheduling by the Client. Embody Wellness is committed to always doing everything possible to accommodate the Client in his/her chosen Activity.
3.3. Embody Wellness reserves the right to change the Class schedule at any time, regardless of prior notice. Changes may include the types of Classes, the number of Classes per week, the days and times of the Classes.
3.4. Embody Wellness reserves the right to change the Class instructor at any time, regardless of prior notice.
3.5. When purchasing a Pack that includes PT Session Activities, the Customer is paying for a training session and not for a specific instructor. Instructors are subject to change without notice at the sole discretion of Embody Wellness.
4. TYPES OF PACKS 4.1. The Client’s participation in any Activities (Open Gym, PT Session and/or Classes) depends on the use of a participation pass which must be previously purchased by the Client in a Pack relating to the type(s) of Activity(ies) he/she wish to carry out. 4.1.1. Embody Wellness offers for purchase different types of packs that comprise 1 or more passes to carry out Activities (“Packs”). The following types of Packs are currently available:

OPEN GYM PACKAGES: Passes for 3 days/week – Valid for 1 month The Client may carry out Open Gym Activities for up to 3 days each week (Monday to Saturday) for a period of 1 month from the date of purchasing the Pack. Unlimited Passes – Valid for 1 month The Client may carry out as many Open Gym Activities as they wish during a period of 1 month from the date of purchasing the Pack. Unlimited Passes – Valid for 1 day The Client will be able to carry out as many Open Gym Activities as they wish during the day of purchasing the Pack.
CLASS PACKS: 1 Pass – Valid for 1 month The Client may take 1 (one) Class during a period of 1 month from the date of purchasing the Pack. 4 Passes – Valid for 1 month The Client may take 4 (four) Classes during a period of 1 month from the date of purchasing the Pack. 8 Passes – Valid for 45 days The Client may take 8 (eight) Classes during a period of 45 calendar days from the date of purchasing the Pack. 12 Passes – Valid for 2 months The Client may take 12 (twelve) Classes during a period of 2 months from the date of purchasing the Pack.
PT SESSION PACKAGES: 8 Passes – Valid for 45 days The Client may carry out 8 (eight) PT Sessions during a period of 45 days from the date of purchasing the Pack. 12 Passes – Valid for 2 months The Client may carry out 12 (twelve) PT Sessions during a period of 2 months from the date of purchasing the Pack. 4.1.2. The validity periods of the Packs, when referred to in days, are counted in calendar days and when referred to in months, they are counted in periods of 30 calendar days.

4.2. Embody Wellness reserves the right to change, at any time, the characteristics of the Packs and other services and/or additional supplements, which will take effect, only for new purchases, from the date of communication of the change on the Website or in the Space, which the Client acknowledges and accepts.
5. PRICES 5.1. Information about Pack prices is available on the Website and in the Space. The prices indicated on the Website and in the Space already include the VAT applicable to the services.
5.2. All Pack prices may be changed by Embody Wellness at any time. Embody Wellness must maintain updated information on Package prices on the Website and in the Space.
5.3. Payment of the Pack´s prices through the Website must be made by credit or debit card or by bank transfer. If purchasing in person at the Space, the Client may also pay in cash. The Client must provide current, complete and accurate payment information.
5.4. Corporate and student discounts are available upon request. For more information, the Client should contact Embody Wellness.
6. SCHEDULING ACTIVITIES, CANCELLATION/RESCHEDULE AND REFUND 6.1. To use the pass(es) included in the Pack purchased, the Client must schedule, via the Website or in person at the Space, the date and time of the respective Activities he/she wish to carry out.
6.2. When purchasing a particular Pack, the Client agrees to the relevant prior notice policy to cancel and/or reschedule scheduled Activities, namely: The Open Gym and PT Session Activities scheduled by the Client may be canceled and/or rescheduled up to a maximum of 24 hours before the start time of the relevant Activity, andClasses scheduled by the Client may be canceled and/or rescheduled up to a maximum of 3 hours before the start time of the relevant Class. 6.1.1 If the Client has scheduled an Activity and he/she does not attend or cancels it after the relevant maximum period referred to in paragraphs a) and b) of paragraph 6.1 above, the Client will lose the respective pass, as if they had actually attended the Activity. 6.1.2. If the Client wishes to cancel or reschedule a scheduled session, he/she must do so within the respective maximum period online via the Website, by telephone, or in person at the Space.

6.2. The Client may not transfer Packs or passes to any third person, nor may they be used by anyone other than the Client. 6.2.1. Any assignment, transfer or disposal of Packs or passes can only be effected at the sole discretion of Embody Wellness and may only be permitted in exceptional circumstances. The amounts paid for the purchase of a Pack are not refundable, in full or in part, by Embody Wellness.
6.3. If an Activity scheduled by the Client is canceled or rescheduled by Embody Wellness, the Client will receive a refund of the corresponding value of the Activity by transfer to the credit card used, by bank transfer or in cash or he/she will have the option to schedule a new one alternative Activity.
6.4. The Client will have the right to suspend the term of a purchased Pack that is still valid, once, for a maximum period of up to 30 calendar days. To do so, the Client must send an email to info@embodylisboa.com requesting the suspension and indicating the end date of such suspension. 6.4.1. The suspension will begin on the date that the aforementioned email is sent by the Client and during this period the Client will not be able to use the passes contained in the suspended Pack. 6.4.2. Once the suspension is ended, the remaining period of the Pack will run again, and the Client will be able to use the remaining passes again.
6.5. The rights of cancellation and refund and any limitation expressed in these terms and conditions do not affect the Client’s legal rights as a consumer.
7. CLIENT’S OBLIGATIONS Without prejudice to any other contractual or legal obligation, the Client undertakes to comply with the following obligations: Pack Purchase Order. The Client must fill out the form for the Pack purchase order with complete, true and updated information, and undertakes to update such information immediately, via the Website or in person, whenever a change occurs; Law of physical activity and sport. Under the terms and for the purposes of the provisions of Law no. 5/2007, of January 16, at the time of purchasing the Pack and throughout the validity of the Pack and duration of the Contract, the Client must ensure that he/she does not have, has no reason to believe that he/she has, nor does reveal any contraindications for the practice of the physical activity that he/she intends to carry out in the Embody Wellness Space, assuming responsibility for the failure to comply with this obligation; Recommendations from Embody Wellness. The Client must comply and follow the recommendations and/or instructions provided by Embody Wellness, directly or through any of its representatives, workers and/or instructors; General duty of behavior. Behave with civility in relationships with all workers, instructors and representatives of Embody Wellness, and also with all the other Clients; and Payments. Timely comply with the obligation to pay for the Packs and any additional payments that may be due, in accordance with the prices in force.
8. ACCESS AND USE OF SPACE 8.1. The use of the Space to carry out Activities is prohibited to minors under 16 years of age.
8.2. The Space’s opening hours are displayed in a visible location and can be changed at any time by Embody Wellness. If the Space’s opening hours are changed by Embody Wellness, Embody Wellness undertakes to display the new hours in advance in a visible location on the Space’s premises.
9. USE OF THE WEBSITE 9.1. The Client agrees to use the Website in accordance with these general conditions, only for legal purposes and in a way that does not breach anyone’s rights or restricts or inhibits anyone’s use and enjoyment of the Website. In case of non-compliance with these terms, Embody Wellness may deny the Client’s access to the Website.
9.2. To schedule an Activity, the Client must follow the instructions for making a reservation as they are displayed on the Website. Any reservation will be subject to Client´s agreement to the general conditions relating to that booking. Embody Wellness will notify the Client of the general conditions that he/she must accept to complete the relevant reservation. The Client may download and print content from the Website only for private, personal and non-commercial use. Embody Wellness does not guarantee that any material available for download is free of infections, viruses, trojans and/or others.
9.3. The Client agrees that he/she will not use the Website to send by electronic card, email, post or otherwise transmit any material that is illegal, threatening, abusive, defamatory, invasive of privacy, vulgar, obscene or profane.
9.4. The Client agrees not to reproduce, distribute, modify or republish our content on another website, frame or mirror the Website or create links to the Website without our prior written consent.
9.5. The Customer agrees not to do anything that interferes or may interfere with the proper functioning of the Website, including, among others, tampering with or hacking the Website or its servers.
9.6. Embody Wellness will work on updating the Website regularly, which may eventually cause temporary suspension of access, services or features, without prior notice. In such unpredictable situations, other means of contact (email, telephone and facilities reception) will remain available. Embody Wellness will not be liable if, for any reason, the Website is unavailable at any time or for any period of time.
9.7. Some areas of the Website may only be accessible using a user identification code and/or password. The Client must keep his/her access password confidential and use it only for their own access. 9.7.1. Embody Wellness may have to (i) limit access to restricted areas, or the entire Website, to registered customers, (ii) disable or suspend access or any password, at any time, in its sole discretion. The issuance of access codes is not a promise of continued use of or access to the Website or any data you may store therein.
9.8. The information contained on the Website is for general information purposes only and is not intended to be comprehensive or to constitute professional medical advice. The information should not be considered or treated as a substitute for specific health or medical advice.
9.9. Clients will be solely and exclusively responsible for accessing or using the content available on the Website, and cannot claim any responsibilities from Embody Wellness arising from possible security breaches or any direct or indirect damages that may occur due to the use of the Website. Embody Wellness is not responsible, directly or indirectly, for any loss or damage caused by viruses, computer attacks or any other technologically harmful material that may infect Clients’ equipment or devices, computer programs, data or other material due to the use of the Website. It is the Client’s sole responsibility to ensure that the computer equipment used to access the Website is adequately protected against harmful software, computer viruses and other forms of intrusion, and Customers must adopt appropriate security measures to prevent the risk of unauthorized access.
9.10. The Client grants Embody Wellness a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence to use (including but not limited to publishing, exploiting and modifying) any Material he/she sends to Embody Wellness by emails, through the Website or posts in any social medias. The term “Materials” covers photographs, images, opinions, texts, comments, phrases, reviews, compliments and mentions. For the avoidance of doubt, the Parties agree that Embody Wellness we will be allowed to use any Material contained in the communications sent by the Client for any purpose whatsoever, to the fullest extent permitted by law
10. RESPONSIBILITY 10.1 The Client declares that he/she is aware and understands that physical and sporting activities carried out at Embody Wellness facilities may expose him/her to various risks inherent to such practices, including accidents, injuries, illnesses or even death.
10.2 The Client undertakes all risks of injury associated with participation in physical Activities carried out at Embody Wellness facilities, including, without limitation, those resulting from falls, contact with other clients, effects of the weather, including high heat and/or humidity.
10.3 The Client undertakes to communicate to Embody Wellness any physical and psychological concerns that may harm or affect the practice of physical activities, in compliance with the obligation referred to in Clause 3, b) above..
10.4 The Client hereby declares and warrants that he/she is physically fit and mentally capable of carrying out the physical Activities he/she chooses to carry out at Embody Wellness facilities.
10.5. The information available on the Website and the services provided through or in connection with Embody Wellness do not constitute medical advice and it is the Client’s responsibility to determine, by obtaining appropriate medical advice, whether they are fit to carry out the desired Activities and that such contents and services are right for him/her. It is not Embody Wellness’s responsibility to do so. Before beginning any exercise regimen, the Client should consult his/her physician.
10.6. Embody Wellness’s liability towards the Client, on a contractual and non-contractual basis, including for acts and/or omissions of its representatives, workers or instructors, only exists in cases in which Embody Wellness has acted with intent or gross negligence, being limited, to the extent allowed by applicable legislation, to the amounts paid by the Client under the Contract.
10.7. The Client declares that he/she has read, is aware of and understands the previous provisions, and that he/she agrees to exempt Embody Wellness, its representatives, workers or instructors from any responsibilities, obligations, demands or claims of any kind in relation to any damages arising or related to the Client’s participation in Embody Wellness trainings, programs and/or events. By signing below, the Client declares that he/she has read and understood this disclaimer and is aware that this is a waiver and an exemption from liability, voluntarily agreeing to its terms.
10.8. Embody Wellness guarantees that its services will be provided with appropriate skill and care.

12. PERSONAL DATA 12.1. When filling out the Pack purchase order, the Client will be asked for certain data that could identify him/her, such as name, photograph, address, NIF, identification document information, email address, telephone number (“Personal Data”), as necessary for the provision of services in connection with the Contract, as well as for direct marketing purposes. Personal Data will be processed by Embody Wellness, in strict compliance with the law.
12.2. To the Client are guaranteed the following rights with regard to his/her Personal Data: (i) right to access personal data, (ii) right to rectification, (iii) right to erasure, (iv) right to limitation, (v ) right to portability, (vi) right to object and, in particular, (vii), right to object to your data being processed for direct marketing purposes. 12.2.1. To exercise any of the rights provided for in Clause 12.2., the Client must contact Embody Wellness via email at info@embodylisboa.com and indicate the right he/she wish to exercise.
13. TERMINATION OF THE CONTRACT 13.1. Without prejudice to any other legal grounds, Embody Wellness may terminate the Contract in the following situations: Impossibility of charging the price of the Pack purchased by the Client;Serious breach by the Client of the provisions of this Contract or of the applicable laws;If Client provides wrong and/or fraudulent information to Embody Wellness, particularly when ordering the purchase of a Pack;Adoption of behaviors that may jeopardize the safety and/or well-being of other Clients and Embody Wellness representatives, workers or instructors, as well as behaviors that cause material damage to the Space and/or to the equipment or, in any way , undermine the reputation or good name of Embody Wellness; andClosure of the Space, as long as Embody Wellness notifies the Client at least 1 month in advance of the closing date.
13.2. Without prejudice to any other legal grounds, the Client may terminate the Contract in the following situations, without, however, being entitled to any compensation for this fact: Within 30 days following the date the Contract is signed, without the need to indicate the reason, by registered letter with acknowledgment of receipt sent to the registered office of Embody Wellness, indicating the right to repentance. In such case, all the amounts paid in virtue of purchasing the Pack will be reimbursed to the Client, except if during this period the Client uses part or all of the passes included in said Pack, in which case he/she will be charged an amount proportional to the passes used, in accordance with applicable legal terms; andIf there is a change to the Contract with which the Client does not agree, as long as they express their disagreement formally in writing and terminate the Contract by the date scheduled for the change to come into force.
13.3. The verification of the occurrence of Acts of God or Force Majeure only constitutes a basis for terminating the Contract if it lasts uninterruptedly for at least 30 days.
14. GENERAL PROVISIONS 14.1. For the purposes of the Contract, communications from the Client must be made by registered letter with acknowledgment of receipt.
14.2. The Parties must notify each other of any change in their identification elements, with the change taking effect within 30 days from the date of notification.
14.3. The provisions of the Contract (consisting of the Purchase Order Form, the Proof of Purchase and these General Conditions) constitute the entire agreement of the Parties regarding its object and replace any and all prior understandings, agreements or communications, oral or written, to the extent which are in conflict with the clauses inserted here. Any change to the Contract is only valid when made in a written document, signed by both Parties, or when made through the Website, by the Client, and accepted by Embody Wellness. 14.3.1. Embody Wellness reserves the right to change the General Conditions from time to time. Such changes will only be applicable to Packs that are purchased at the time the new version of the General Conditions is in force, as published on the Website, and therefore there will be no retroactivity for previously signed Contracts.
14.4. The Contract is governed by Portuguese law and for the resolution of any and all controversies or disputes, directly or indirectly related to it, the Lisbon District Court has territorial jurisdiction, without prejudice to the applicable mandatory legal rules.
14.5. In case of discrepancy or divergence between the English version and the Portuguese version of this Contract, the latter will prevail.

As disposições constantes destas condições gerais aplicam-se e regem o contrato celebrado presencialmente ou através deste website www.embodylisboa.com (o “Website”) entre a Routinealangement Lda., sociedade comercial por quotas, matriculada sob o número único de matrícula e identificação fiscal 517557398, com sede na Rua Ferreira Lapa, nº 26A, R/C 31, 1150-158 Lisboa (Freguesia de Arroios) (a “Embody Wellness”) e o/a cliente (“Cliente”), identificado/a no comprovativo de adesão contratual, quanto ao acesso e à utilização pelo/a Cliente das instalações físicas do espaço localizado à Rua Ferreira Lapa, nº 26A, R/C 31 (o “Espaço”), bem como dos equipamentos e serviços prestados pela Embody Wellness relativamente à prática de atividades físicas e desportivas (“Contrato”).
O Website pertence e é operado pela Embody Wellness. Estes termos e condições incluem as condições gerais de utilização deste Website e do Contrato relativo aos serviços prestados pela Embody Wellness no Website e no Espaço. O/A Cliente deverá ler cuidadosamente as presentes condições gerais e declarar concordância com os presentes termos e condições.
1. OBJETO DO CONTRATO O Contrato tem como objeto (i) o acesso ao Espaço da Embody Wellness pelo/a Cliente, bem como (ii) a utilização, pelo/a Cliente, das instalações do Espaço, dos equipamentos e serviços prestados pela Embody Wellness para a prática de atividades físicas e desportivas.
2. CELEBRAÇÃO DO CONTRATO 2.1. O Contrato considerar-se-á celebrado entre a Embody Wellness e o/a Cliente no momento em que o pedido de compra dos Pacotes de treino, submetido eletronicamente pelo/a Cliente através deste Website ou presencialmente no Espaço, for efectivamente aceite pela Embody Wellness. 2.1.1. A aceitação considera-se efectuada na data em que a Embody Wellness enviar ao/à Cliente o comprovativo de aceitação, eletronicamente através do Website, por email ou por documento físico entregue presencialmente no Espaço. 2.1.2. Se, por qualquer razão, a Embody Wellness recusar o pedido de compra submetido pelo/a Cliente, o contrato não será considerado validamente celebrado e os valores pagos pelo/a Cliente no momento do pedido de compra serão restituídos no prazo de 5 dias, não sendo devida qualquer indemnização pela Embody Wellness ao/à Cliente.


3. ATIVIDADES DISPONIBILIZADAS PELA EMBODY WELLNESS 3.1. As atividades físicas disponibilizadas pela Embody Wellness no Espaço compreendem (em conjunto as “Atividades”): Utilização do espaço aberto do Espaço, incluindo os materiais e equipamentos disponíveis, pelo Cliente (“Open Gym”);Sessão de treinamento pessoal com Personal trainer alocado pela Embody Wellness (“Sessão PT”); eAulas de grupo para um grupo de Clientes conduzidas por instrutor alocado pela Embody Wellness (“Aulas”).
3.2. A participação do Cliente nas Atividades físicas promovidas pela Embody Wellness está sempre sujeita à disponibilidade de vagas para agendamento pelo Cliente. A Embody Wellness se compromete a fazer sempre o possível para acomodar o/a Cliente na Atividade escolhida.
3.3. A Embody Wellness reserva-se o direito de alterar o mapa de Aulas, a qualquer momento, independentemente de aviso prévio. As alterações poderão incluir, as modalidades de Aulas, o número de Aulas por semana, os dias e horários das Aulas.
3.4. A Embody Wellness reserva-se o direito de alterar o instrutor das Aulas, a qualquer momento, independentemente de aviso prévio.
3.5. Ao comprar um Pacote que inclua Atividades de Sessão PT, o/a Cliente está a pagar uma sessão de treinamento e não por um instrutor específico. Os instrutores estão sujeitos a alterações sem aviso prévio a exclusivo critério da Embody Wellness.
4. MODALIDADES DE PACOTES 4.1. A participação do/a Cliente em quaisquer Atividades (Open Gym, Sessão PT e/ou Aulas) presume a utilização de um passe de participação o qual deverá ser previamente adquirido pelo/a Cliente no Pacote referente à(s) modalidade(s) de Atividade(s) que este deseja realizar. 4.1.1. A Embody Wellness disponibiliza para aquisição diferentes tipos de pacotes que compreendem 1 ou mais passes para realização de Atividades (“Pacotes”). No momento, estão disponíveis as seguintes modalidades de Pacotes:

PACOTES OPEN GYM: Passes por 3 dias/Semana – Válido por 1 mês O/A Cliente poderá realizar Atividades de Open Gym por até 3 dias a cada semana (segunda a sábado) durante o prazo de 1 mês contado da data de aquisição do Pacote. Passes ilimitados – Válido por 1 mês O/A Cliente poderá realizar quantas Atividades de Open Gym desejar durante o prazo de 1 mês contado da data de aquisição do Pacote. Passes ilimitados – Válido por 1 dia O/A Cliente poderá realizar quantas Atividades de Open Gym desejar durante o dia de aquisição do Pacote.
PACOTES AULAS: 1 Passe – Válido por 1 mês O/A Cliente poderá realizar 1 (uma) Aula durante o prazo de 1 mês contado da data de aquisição do Pacote. 4 Passes – Válido por 1 mês O/A Cliente poderá realizar 4 (quatro) Aulas durante o prazo de 1 mês contado da data de aquisição do Pacote. 8 Passes – Válido por 45 dias O/A Cliente poderá realizar 8 (oito) Aulas durante o prazo de 45 dias corridos contados da data de aquisição do Pacote. 12 Passes – Válido por 2 meses O/A Cliente poderá realizar 12 (doze) Aulas durante o prazo de 2 meses contados da data de aquisição do Pacote.
PACOTES SESSÃO PT: 8 Passes – Válido por 45 dias O/A Cliente poderá realizar 8 (oito) Sessões PT durante o prazo de 45 dias contado da data de aquisição do Pacote. 12 Passes – Válido por 2 meses O/A Cliente poderá realizar 12 (doze) Sessões PT durante o prazo de 2 meses contado da data de aquisição do Pacote. 4.1.2. Os prazos de validade dos Pacotes, quando referidos em dias, são contados em dias corridos e quando referidos em meses, são contados em períodos de 30 dias corridos.

4.2. A Embody Wellness reserva-se o direito de alterar, a todo o momento, as características dos Pacotes e outros serviços e/ou suplementos adicionais, que produzirão efeitos, somente para as novas aquisições, a partir da data de comunicação da alteração no Website ou no Espaço, o que o/a Cliente reconhece e aceita.
5. PREÇOS 5.1. A informação sobre preços dos Pacotes está disponível no Website e no Espaço. Os preços indicados no Website e no Espaço já incluem o IVA aplicável aos serviços.
5.2. Todos os preços de Pacotes podem ser alterados pela Embody Wellness a qualquer momento. A Embody Wellness deverá manter informação atualizada dos preços de Pacotes no Website e no Espaço.
5.3. O pagamento do preço dos Pacotes através do Website deverá ser feito por cartão de crédito ou de débito ou por transferência bancária. No caso de compra pessoalmente no Espaço, o/a Cliente poderá, ainda, pagar em dinheiro. O/A Cliente deverá fornecer informações de pagamento atuais, completas e precisas.
5.4. Descontos corporativos e para estudantes estão disponíveis mediante solicitação. Para mais informações, o/a Cliente deverá contactar a Embody Wellness.
6. AGENDAMENTO DE ATIVIDADES, CANCELAMENTO/REAGENDAMENTO E REEMBOLSO 6.1. Para utilização do(s) passe(s) incluído(s) no Pacote que adquirir, o/a Cliente deverá agendar, através do Website ou pessoalmente no Espaço, a data e a hora das respectivas Atividades que deseja realizar.
6.2. Ao adquirir determinado Pacote, o/a Cliente concorda com a respetiva política de aviso prévio para cancelar e/ou reagendar as Atividades agendadas, nomeadamente: As Atividades de Open Gym e Sessão PT agendadas pelo/a Cliente poderão ser canceladas e/ou reagendadas até o prazo máximo de 24 horas antes do horário de início da Atividade em questão, e As Aulas agendadas pelo/a Cliente poderão ser canceladas e/ou reagendadas até o prazo máximo de 3 horas antes do horário de início da Aula em questão. 6.1.1 Caso o/a Cliente tenha agendado uma Atividade e não compareça ou a cancele após o respetivo período máximo referido nas alíneas a) e b) do nº 6.1 acima, o/a Cliente perderá o respetivo passe, como se tivesse comparecido à Atividade. 6.1.2. Caso o/a Cliente deseje cancelar ou reagendar uma sessão agendada, deverá fazê-lo dentro do respectivo período máximo online através Website, por telefone, ou pessoalmente no Espaço.

6.2. O/A Cliente não poderá transferir Pacotes ou passes para qualquer outra pessoa, nem poderá permitir que sejam utilizados por outra pessoa que não seja o/a próprio/a Cliente. 6.2.1. Qualquer cessão, transferência ou alienação de Pacotes ou passes fica a critério exclusivo da Embody Wellness e só pode ser permitida em circunstâncias excepcionais. Os valores do Pacote adquirido não são reembolsáveis, integral ou parcialmente, pela Embody Wellness.
6.3. Caso uma Atividades agendada pelo/a Cliente seja cancelada ou reagendada pela Embody Wellness, o/a Cliente receberá um reembolso do correspondente valor da Atividade mediante transferência para o cartão de crédito utilizado, transferência bancária ou em dinheiro ou terá a opção de agendar uma nova Atividade alternativa.
6.4. O/A Cliente terá direito a suspender o prazo do Pacote adquirido que ainda esteja válido, uma única vez, por um período máximo de até 30 dias corridos. Para tanto, o/a Cliente deverá enviar um email para info@embodylisboa.com a solicitar a suspensão e indicar a data de fim da suspensão. 6.4.1. A suspensão se iniciará na data de envio do referido email pelo/a Cliente e durante este período o/a Cliente não poderá utilizar os passes contidos no Pacote suspenso. 6.4.2. Finalizada a suspensão, o prazo remanescente do Pacote voltará a correr, podendo o/a Cliente voltar a utilizar os passes restantes.
6.5. Os direitos de cancelamento e reembolso e qualquer limitação expressa nestes termos e condições não afetam os direitos legais do/a Cliente como consumidor/a.
7. DEVERES DO/A CLIENTE Sem prejuízo de quaisquer outras obrigações contratuais ou legais, o/a Cliente obriga-se a cumprir os seguintes deveres: Pedido de Compra de Pacote. O/A Cliente deverá preencher o seu formulário de pedido de compra de Pacote com informações completas, verdadeiras e atualizadas, e compromete-se a atualizá-las de imediato, através do Website ou presencialmente, sempre que ocorra uma alteração nas mesmas; Lei de Bases da atividade física e do desporto. Nos termos e para os efeitos do disposto na Lei n.º 5/2007, de 16 de Janeiro, no momento da compra do Pactote e durante toda a validade do Pacote e duração do Contrato, o/a Cliente deverá assegurar-se de que não possui, não tem razão para acreditar que possui, nem revela quaisquer contra-indicações para a prática da atividade física que pretende realizar no Espaço da Embody Wellness, assumindo a responsabilidade pelo incumprimento deste dever; Recomendações da Embody Wellness. O/A Cliente deverá observar e seguir as recomendações e/ou instruções que lhe forem fornecidas pela Embody Wellness, diretamente ou através de qualquer dos seus representantes, trabalhadores e/ou colaboradores; Dever geral de urbanidade. Comportar-se com urbanidade nas relações com os trabalhadores, colaboradores e representantes da Embody Wellness, e ainda com os outros/as Clientes; e Pagamentos. Cumprir pontualmente com a obrigação de pagamento dos Pacotes e dos eventuais pagamentos adicionais que sejam devidos, de acordo com os preços em vigor.
8. ACESSO E UTILIZAÇÃO DO ESPAÇO 8.1. A utilização do Espaço para prática de Atividades é vedada a menores de 16 anos.
8.2. O horário de funcionamento do Espaço encontra-se afixado em local visível no mesmo, podendo ser alterado a todo o momento pela Embody Wellness. Caso o horário de funcionamento do Espaço seja alterado pela Embody Wellness, esta compromete-se a afixar o novo horário com a devida antecedência em local visível nas instalações do Espaço.
9. USO DO WEBSITE 9.1. O/A Cliente concorda em usar o Website de acordo com estas condições gerais, apenas para fins legais e de uma forma que não infrinja os direitos de ninguém ou restrinja ou iniba o uso e aproveitamento do Website por alguém. Em caso de incumprimento destes termos, a Embody Wellness poderá negar ao/à Cliente o acesso ao Website.
9.2. Para efetuar uma reserva de Atividade, o/a Cliente deverá seguir as instruções para efetuar uma reserva conforme aparecem no Website. Qualquer reserva estará sujeita à concordância do/da Cliente com as condições gerais relativas a essa reserva. A Embody Wellness notificará o/a Cliente sobre as condições gerais que este/a deverá aceitar para concluir a reserva em questão. O/A Cliente poderá descarregar e imprimir conteúdo do Website apenas para uso privado, pessoal e não comercial. A Embody Wellness não garante que qualquer material disponível para download esteja livre de infecções, vírus, trojans e/ou outros.
9.3. O/A Cliente concorda que não usará o Website para enviar por cartão eletrônico, e-mail, para postar ou transmitir de qualquer outra forma qualquer material que seja ilegal, ameaçador, abusivo, difamatório, invasivo de privacidade, vulgar, obsceno ou profano.
9.4. O/A Cliente concorda em não reproduzir, distribuir, modificar ou republicar nosso conteúdo em outro site, enquadrar ou espelhar o Website ou criar links para o Website sem nosso consentimento prévio por escrito.
9.5. O/A Cliente concorda em não fazer nada que interfira ou possa interferir no bom funcionamento do Website, incluindo, entre outros, adulterar ou invadir o Website ou os seus servidores.
9.6. A Embody Wellness trabalhará para atualizar o Website regularmente, o que poderá eventualmente causar a suspensão temporária do acesso, dos serviços ou das funcionalidades, sem aviso prévio. Em tais situações imprevisíveis, os demais meios de contacto (email, telefone e receção das instalações) permanecerão disponíveis. A Embody Wellness não poderá ser responsabilizada se, por qualquer motivo, o Website estiver indisponível a qualquer momento ou por qualquer período de tempo.
9.7. Algumas áreas do Website poderão ser acessíveis apenas por meio de um código de identificação de usuário e/ou senha. O/A Cliente deverá manter sua senha de acesso confidencial e usá-la somente para seu próprio acesso. 9.7.1. A Embody Wellness poderá ter que (i) limitar o acesso às áreas restritas, ou a todo o Website, aos clientes que se registraram, (ii) desabilitar ou suspender o acesso ou qualquer senha, a qualquer momento, a seu exclusivo critério. A emissão de códigos de acesso não é uma promessa de uso contínuo ou acesso Website ou a quaisquer dados que o cliente possa armazenar nele.
9.8. As informações contidas no Website são apenas para fins de informação geral e não pretendem ser abrangentes ou constituir aconselhamento médico profissional. As informações não devem ser consideradas nem tratadas como um substituto para conselhos médicos ou de saúde específicos.
9.9. Os/as Clientes serão os únicos e exclusivos responsáveis pelo acesso ou utilização dos conteúdos disponibilizados no Website, não podendo reclamar quaisquer responsabilidades à Embody Wellness decorrentes de eventuais violações de segurança ou quaisquer danos, diretos ou indiretos, que possam ocorrer devido à utilização do Website. A Embody Wellness não se responsabiliza direta ou indiretamente por qualquer perda ou dano causado por vírus, ataque informático ou qualquer outro material tecnologicamente prejudicial que possa infetar equipamentos ou dispositivos dos/as Clientes, programas de computador, dados ou outro material devido ao uso do Website. É da exclusiva responsabilidade do Cliente assegurar que o equipamento informático que utiliza no acesso ao Website se encontra adequadamente protegido contra softwares nocivos, vírus informáticos e outras formas de intrusão, devendo os/as Clientes adotar as medidas de segurança adequadas de modo a impedir o risco de acessos não autorizados.
9.10. O/A Cliente concede à Embody Wellness uma autorização geral, não exclusiva, perpétua, irrevogável, isenta de royalties para usar (incluindo, entre outros, para a publicação, exploração e modificação) qualquer Material que o/a Cliente enviar à Embody Wellness por e-mail, por postagens em redes sociais ou através do Website. O termo “Materiais” abrange fotografias, imagens, opiniões, textos, comentários, frases, críticas, elogios e menções. Para evitar dúvidas, as Partes concordam que a Embody Wellness poderá utilizar quaisquer Materiais contidos nas comunicações remetidas pelo/a Cliente para qualquer finalidade, em toda a extensão permitida por lei.
10. RESPONSABILIDADE 10.1. O/A Cliente declara que está ciente e compreende que as atividades físicas e desportivas realizadas nas instalações da Embody Wellness poderão expô-lo/la a variados riscos inerentes a tais práticas, incluindo acidentes, lesões, doenças ou até morte.
10.2. O/A Cliente assume todos os riscos de lesões associados à participação nas Atividades físicas realizadas nas instalações da Embody Wellness, incluindo, sem limitação, as decorrentes de quedas, do contacto com outros clientes, efeitos do clima, incluindo calor e/ou umidade elevados.
10.3. O/A Cliente se obriga a comunicar à Embody Wellness quaisquer preocupações físicas e psicológicas que possam prejudicar ou afetar a prática das atividades físicas, em observância ao dever referido na Cláusula 3, b), acima.
10.4. Pelo presente, o/a Cliente declara e garante que está fisicamente apto/a e mentalmente capaz de realizar as Atividades físicas que escolher realizar nas instalações da Embody Wellness.
10.5. As informações disponíveis no Website e os serviços fornecidos através ou em conexão com a Embody Wellness não constituem aconselhamento médico e é responsabilidade do/da Cliente determinar, através da obtenção de aconselhamento médico apropriado, se está apto à realização das Atividades desejadas e que tais conteúdos e serviços são adequados para si. Não é responsabilidade da Embody Wellness fazê-lo. Antes de iniciar qualquer regime de exercícios, o/a Cliente deve consultar seu médico.
10.6. A responsabilidade da Embody Wellness perante o/a Cliente, a título contratual e extracontratual, incluindo por atos e/ou omissões dos seus representantes, trabalhadores ou instrutores, só existe nos casos em que a Embody Wellness tenha procedido com dolo ou culpa grave, encontrando-se limitada, na medida do permitido pela legislação aplicável, aos montantes pagos pelo/a Cliente no âmbito do Contrato.
10.7. O/A Cliente declara que leu, tomou conhecimento e compreendeu as anteriores disposições, e que concorda, em isentar a Embody Wellness, seus representantes, trabalhadores ou instrutores de quaisquer responsabilidades, obrigações, demandas ou reivindicações de qualquer tipo relativamente a eventuais danos decorrentes ou relacionados à participação do/a Cliente nos treinamentos, programas e/ou eventos da Embody Wellness. Pela sua assinatura o/a Cliente declara que leu e compreendeu esta isenção de responsabilidade e está ciente de que isto é uma renúncia e uma isenção de responsabilidade, concordando voluntariamente com seus termos.
10.8. A Embody Wellness garante que os seus serviços serão fornecidos com habilidade e cuidado adequados.

12. DADOS PESSOAIS 12.1. No preenchimento do pedido de compra de Pacote, serão solicitados ao/à Cliente determinados dados suscetíveis de o identificar, tais como nome, fotografia, morada, NIF, informações do documento de identificação, endereço de email, número de telefone (“Dados Pessoais”), conforme sejam necessários para a prestação dos serviços em conexão com o Contrato, bem como para atividades de marketing direto. Os Dados Pessoais serão tratados pela Embody Wellness, no estrito cumprimento da lei.
12.2. Ao/À Cliente são garantidos os seguintes direitos no que respeita aos seus Dados Pessoais: (i) direito de acesso aos dados pessoais, (ii) direito de retificação, (iii) direito de apagamento, (iv) direito à limitação, (v) direito de portabilidade, (vi) direito à oposição e, em especial, (vii), direito a opor-se que os seus dados sejam tratados para fins de marketing direto. 12.2.1. Para exercício de qualquer dos direitos previstos na Cláusula 12.2., o/a Cliente deverá contactar a Embody Wellness através do email info@embodylisboa.com indicando o direito que deseja exercer.
13. CESSAÇÃO DO CONTRATO 13.1. Sem prejuízo de quaisquer outros fundamentos legais, a Embody Wellness poderá resolver o Contrato nas situações seguintes: Impossibilidade de cobrança do preço do Pacote adquirido pelo/a Cliente;Violação grave, pelo/a Cliente do disposto no presente Contrato ou nas leis aplicáveis;Prestação de informações erróneas e/ou fraudulentas pelo/a Cliente à Embody Wellness, designadamente no ato de pedido de compra de Pacote;Adopção de comportamentos que possam colocar em causa a segurança e/ou o bem-estar dos demais Clientes e dos representantes, trabalhadores ou instrutores da Embody Wellness, bem como comportamentos que causem danos materiais ao Espaço e/ou aos equipamentos ou, de algum modo, ponham em causa a reputação ou o bom nome da Embody Wellness; e Encerramento do Espaço desde que a Embody Wellness avise o/a Cliente com, pelo menos, 1 mês de antecedência face à data de encerramento.
13.2. Sem prejuízo de quaisquer outros fundamentos legais, o/a Cliente pode resolver o Contrato nas situações seguintes, sem que tenha, porém, direito a qualquer compensação por esse facto: Nos 30 dias seguintes à data de celebração do Contrato, sem necessidade de indicação do motivo, mediante carta registada com aviso de receção enviada para a sede social da Embody Wellness, a indicar o direito de arrependimento, sendo-lhe devolvidos todos os montantes pagos em virtude da compra do Pacote, exceto se durante esse período o/a Cliente utilizar parte ou a totalidade dos passes incluído no referido Pacote, caso em que lhe será cobrado um valor proporcional aos passes utilizados, nos termos legais aplicáveis; e No caso de se verificar uma alteração do Contrato com a qual o/a Cliente não concorde, desde que manifeste o seu desacordo formalmente por escrito e resolva o Contrato até à data prevista para a entrada em vigor da alteração.
13.3. A verificação da ocorrência de Caso Fortuito ou de Força Maior, só constitui fundamento de resolução do Contrato caso perdure ininterruptamente durante, pelo menos, 30 dias.
14. DISPOSIÇÕES GERAIS 14.1. Para os efeitos do Contrato, as comunicações do/a Cliente têm que ser realizadas por carta registada com aviso de receção.
14.2. As Partes devem notificar-se reciprocamente de qualquer alteração dos seus elementos de identificação, produzindo a alteração efeitos no prazo de 30 dias contados da data da notificação.
14.3. O disposto no Contrato (composto pelo Formulário de pedido de compra, o Comprovativo de Compra e essas Condições Gerais) constitui o acordo integral das Partes relativamente ao seu objeto e substitui todos e quaisquer entendimentos, acordos ou comunicações prévias, orais ou escritos, na medida em que estejam em conflito com as cláusulas aqui inseridas. Qualquer alteração ao Contrato só é válida quando feita por documento escrito, assinado por ambas as Partes, ou quando efetuada através do Site, pelo/a Cliente, e aceite pela Embody Wellness. 14.3.1. A Embody Wellness reserva-se o direito de alterar as Condições Gerais de tempos em tempos. Tais alterações somente serão aplicáveis aos Pacotes que forem adquiridos no momento que a nova versão das Condições Gerais estiver em vigor, conforme publicada no Website, não havendo, portanto, retroatividade para os Contratos celebrados anteriormente.
14.4. O Contrato rege-se pela lei Portuguesa e para a resolução de todo e qualquer controvérsia ou litígio, direta ou indiretamente relacionado com o mesmo, é territorialmente competente o Tribunal da Comarca de Lisboa, sem prejuízo das normas legais imperativas aplicáveis.
14.5. Em caso de discrepância ou divergência entre a versão em inglês e a versão em português deste Contrato, prevalecerá a última.
